Registration Law of
Political Parties, is a Necessity

As the things
getting ugly, those days in National Parliament because of the
fruitful of peace dividend, sharing powers between the SPLM
party and “what so called” other southern political parties. And
most of all, the majority of those parties, they have no based
at the grassroots levels. Even at National, State, County and
Boma. But they are fighting for their political survival, to be
a part south mainstream which it’s okay however, the SPLM party,
as a one who is in charge of all affairs of the government in
south Sudan.
So party have to
fill in, all loopholes by locking many doors in the face of
those parties leaders whom sometimes claims seats in the
(National Parliament); meanwhile they are really played a old
political game without having a solid base in the ground. Some
of those parties, are just a symbolic parties, they cannot to be
find in anywhere at all levels that I identified at the top
paragraph. Those parties, are the most supportive of the ideals
policies of tribalistic, nepotism and ethnics.
For instance, we
have an absolute tramples parties, whom always, gave the SPLM
troubled with public or voters on the issues concerning a united
of south Sudanese tribes and their presentations. Eventually,
the defectors parties of SPLM – DC and the United Democratic
Front have been solely preaching the ideas of hate-rage and
tribalistic policies, amongst southerners. Both parties, at the
most involving in many insecurity and political turmoil in the
south Sudan. Ongoing fighting tribal in some states of south
Sudan. SPLM- DC party has allegedly behind Upper Nile state’s
atrocities of (2010 - 2011) by its military wing in the state.
Meanwhile, the UDF leader’s fighting verbally, using effective
tools of war, words of mouth, sometimes UDF leader made, CE,
state’s land as an issue between local state’s citizens and
those whom they considered to be outsiders or other tribe’s
settlers.
But what would be
solutions for massive problems, and how do you get rid of those
kinds of the parties. Argument, the SPLM party and its
government need to set up proposal that’s governing political
activities in the country. And I think that the party and other
political parties, must form a supervisory commission and it
will be call a “Judicial Committee JC”; and that will prior be
agreed upon with other parties in the south Sudan.
Ironically, this
agency must led by the (Chief Registrar) and its chairperson
will be obviously a legal background person, in addition to
other membership of committee. This position will be name after
maximal consultation with various parties in all southern
states. But all parties must be entitled to take oath on the
principals that party must declassified its
constitution, manifesto programs and vision, all contains
must complies with political party’s
act as a condition for the party
to get registration license in the south Sudan.
Below are a series
of conditions or laws and regulations that’s qualifying
political party to register in the south Sudan.

The political party
can be legally registered just notifying a Chief of Judicial
Committee office, when there’s no any objection raise within a
period of 30 days so the party’s okay to go ahead with
procedural steps. If there’s any objections be raised, they must
be referred within a (Seven – 15 days) to the Higher Court in
the land. In which the Court would either confirm or quash

Each political
party must pay amount of (100,000 – 250,000 SSP), south Sudanese
Pound only as a registration fees to the Office of Chief
Registrar of political parties, all registration fees considered
to be operational cost for the agency office.

The political party
can apply to the Judicial Committee JC, for approval, and when
it’s get operational permit. This party’s needed a procuring of
10,000 signatures of potential members. The putative membership
of that party must be drawn from all 10 states of south Sudan or
more governorates states, and if at all, less its must be no
fewer than from 5 states of the nation.

The political
party’s funders groups or generally party’s finance declaration
must be known to the public.

The Legal
Committee, JC, will be examining the papers of new parties and
they must ensure that any given registration party’s obsessed
with the ideas that prohibit a parties whom favoring a
religious, tribalistic, nepotism and other forms of
discriminatory.

The political party
must offers a manifesto, or program that address all massive
social issues, economy, political and religious.

Nonetheless, all
national parties in the country are equally before the Court of
law and they must be given money equally, in any eve of election
– cycles as preparatory package subsidy before election
electorate system.
But the political parties are to be prohibited or ban from
registration process under the following circumstances:

The political party
must have its political programme which is completely distinct
from any existing parties but it will be a job of Chief
Registrar Office to assess such programmes and, by extension,
decide whether or not the party should be registered, if there’s
similarity with other parties in term of program.

The political party
will be ban or prohibited from getting a registration license,
if there’s a proven evidence before
the Court of Law, or that’s party’s
leader convicted of fueling a tribal fighting or
allegedly the party’s leaders are involving in the issues
concerning national security.

The political
party’s ban or prohibited from the registration license, if the
party’s leader’s a supportive of tribalistic agenda or working
to advance one tribe on the expanse of others tribes.

Initial closing of
this essay, I would again maintain my early position, as I
believe in the party SPLM and R.S.S government. Both are
directly be hold accountable to lead this process of regulating
a political system. By calling all political parties, to first
find a commission for political party’s registration law or act.
